Terms of Service! Included on this page is the xNetWham Terms of Service and Policies.
All server owners are required to acknowledge this as a condition of purchase.
Responsibility
Company Responsibilities - Insure that your service experience is pleasant and that all your customer related needs are addressed. For hosting purposes we monitor our networks and systems that host our servers 24 hours a day 7 days a week.
Customer Responsibilities - You are responsible for the settings on your server. If your server is down please notify us as soon as possible via a support ticket found on our web site to make sure your service is back online. While we DO monitor servers on an individual basis, we can't catch every outage every time. You must notify us if your server is experiencing problems or your server is down through our support area of our web site. We want to help limit the amount of downtime you may experience due to server crashes etc.
You must insure that your server abides by our term of service at all times.
Your dedicated server, server, shell, game server or any other service provided by xNetWham, must stay compliant with our Terms of Service at all times.
Paying for service - All payments are due before service is rendered. A service month is 30 days, if you have paid for service for 3 months then you have 90 days of service.
Service payments are expected on or before your next bill date. If you no longer require service we require you to go to our cancel service page and put in a cancel request. Requests to discontinue service must be entered no later then 7 days before your next payment date to avoid additional service charges.
Private Game Servers - If you ordered a password protected server then the server must be that: Locked down 99% of the time except when you need to coordinate scrims, etc. Loaning your server out to another clan is permitted. Extreme/heavy use of a private will result in the premature cancellation of your server (our definition: 10 hours a day - every day - is a busy private and we suggest you purchase a public!
Bots in game servers - Bots take up an exorbitant amount of CPU. We do not allow Bots on our network. This is to be fair to all and keep prices as low as reasonable!
Refunds - You are eligible for a refund if we do not maintain 95% hardware or network uptime based on a 30 day period over the system your service is hosted on or we are unable to correct or fix service related issues that are a result of no fault of your own. You are then eligible for a prorated refund.
While your ping times will be more then enjoyable on our service we will not issue refunds that are due to ping issues with you or your server members. Since there are so many ways to travel on the internet it would be impossible for anyone to guarantee internet ping times. We do our best to host your game server on the best bandwidth quality as possible. All refunds are based on a prorated remainder of your service time and may only be requested by email paypal@xnetwham.com.
Service Credits - We will credit your account if your server is down for a period of time of more then 8 hours in any given day due to hardware or network issues. Credits will be determined by our staff at the time of the issue and will be credited directly to your online account once the issue is resolved. Service credits may not be paid in cash, or refunded to credit cards. 3 Day Change your mind Policy - If for whatever reason you do not wish to keep service with us you can request a refund for service if within your first 72 hours of service. Since we do not charge a setup fee for our service there will be a charge of $39.00 deducted from your refund to cover our setup and staff costs.
Additional Terms Pricing Subject to Change - Prices are subject to change with little or no notice at anytime. Your will be subject to those price changes when your service renewal comes up. In order to be in effect for a pricing change you must contact our billing department.
Upgrades and Patches - We will patch game server as needed by the game designers at no charge to you. . Game Servers are setup with the base install according to the game type ordered. The price you pay when signing for service will remain in effect until you cancel.
Failure to Comply - Failure to comply with all current and future Terms of Service Agreements can result in termination of your account and/or service interruption. We will immediately shutdown a server if we find your server is in violation of our Terms of Service, until the account holder insures us his/her game server does comply with our Terms of Service. If a user has excessive violations then his account can be terminated with no refunds.
